Affiliate Programme – Terms of Use

These Affiliate Programme Terms of Use (“Terms”) govern participation in the affiliate programmes operated by Mooiste Meisie and Umuhle Cosmetics (“the Company”, “we”, “our”, “us”).

By applying to or participating in our Affiliate Programme, you (“Affiliate”, “you”, “your”) agree to be bound by these Terms in full.

1. Programme Overview

The Affiliate Programme allows approved affiliates to promote our products and earn a 5% commission on qualifying sales generated through their unique referral links and/or approved coupon codes.

Participation is subject to approval and ongoing compliance with these Terms.

2. Eligibility & Approval

  • Affiliates must be 18 years or older.
  • Applications are reviewed at our discretion.
  • We reserve the right to approve or reject any application without obligation to provide reasons.
  • Approval does not guarantee continued participation.

3. Commission Structure

  • Commission rate: 10% per confirmed sale.
  • Commission is calculated on the order subtotal, excluding:
    • Shipping fees
    • Taxes
    • Discounts
  • Commission is earned only on:
    • Paid orders
    • Completed orders
    • Non-refunded and non-cancelled orders

We reserve the right to amend commission structures with reasonable notice.

4. Tracking & Attribution

  • Sales are tracked using AffiliateWP tracking technology.
  • The Affiliate is responsible for using their unique referral link or approved code.
  • We are not responsible for commissions lost due to:
    • Cookie blocking
    • Incorrect link usage
    • Technical interference outside our control

5. Payments & Payouts

  • Commissions are paid monthly, subject to verification.
  • A minimum payout threshold may apply.
  • Payments are made via EFT to the affiliate’s nominated bank account.
  • Affiliates are responsible for providing accurate payment details.
  • We are not liable for delays caused by incorrect banking information.

6. Refunds, Returns & Chargebacks

  • If a customer order is refunded, cancelled, or charged back:
    • The related commission will be reversed or deducted.
  • Repeated high refund rates may result in suspension or termination.

7. Promotional Guidelines

Affiliates must:

  • Promote products honestly and accurately
  • Avoid false, misleading, or exaggerated claims
  • Disclose affiliate relationships where legally required
  • Use only approved brand assets
  • Not alter logos, product names, packaging visuals, or pricing

Affiliates may not:

  • Engage in spam, paid traffic fraud, or misleading advertising
  • Bid on brand trademarks in paid ads without written permission
  • Represent themselves as employees or official representatives
  • Undercut pricing or offer unauthorised discounts

8. Brand Conduct & Reputation

Affiliates must maintain respectful conduct aligned with our brand values.

We reserve the right to suspend or terminate affiliates who engage in:

  • Harassment or abusive behaviour
  • Brand damage or reputational harm
  • Public misinformation about the company
  • Unethical or unlawful activity

9. Termination

Either party may terminate participation at any time.

We reserve the right to terminate immediately for:

  • Breach of these Terms
  • Fraudulent activity
  • Misrepresentation
  • Repeated policy violations

Upon termination:

  • Pending commissions may be forfeited if earned unlawfully or in violation of these Terms.

10. Independent Contractor Relationship

Affiliates are independent contractors.

Nothing in these Terms creates:

  • An employment relationship
  • A partnership
  • A franchise
  • An agency relationship

Affiliates have no authority to bind the Company.

11. Tax Responsibility

Affiliates are solely responsible for:

  • Declaring income
  • Paying applicable taxes
  • Meeting regulatory obligations in their jurisdiction

12. Limitation of Liability

We shall not be liable for:

  • Indirect or consequential losses
  • Loss of income or profits
  • Tracking failures beyond reasonable control

Participation is at the affiliate’s own risk.

13. Amendments

We reserve the right to update or modify these Terms at any time.

Continued participation after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
